BRAKE PART SWEEPSTAKE: TAG A FRIEND WHO LACKS...

1. Eligibility
  • The "Brake Part" Sweepstake (in the following now called “sweepstake”) is open to legal residents who reside in Europe.
  • Entrants must be 18 years old as of their date of entry in this promotion in order to qualify.
  • This sweepstake is subject to federal, state, and local laws and regulations and void where prohibited by law. 
  • Trickstuff employees, its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the sweepstake. 
  • Instagram business accounts are also excluded from participating.
2. SPONSORSHIP
  • The Sponsor is Trickstuff GmbH (Sponsor), located at Schwabenmatten 17a, 79292, Pfaffenweiler, Germany.
  • The sweepstake will be implemented via the Instagram account @trickstuff_official.
  • The Sponsor will conduct the sweepstake substantially as described in these Official Rules. 
3. Agreement to Rules

By entering this sweepstake, the Entrant (“You” or “Your”) agrees to abide by the Sponsor's Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this sweepstake, You represent and warrant that You are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this sweepstake. 

 

4. Sweepstake Entry Period 

The sweepstake will take place between 01.10.2024 and 31.12.2024. The sweepstake consists of several posts, within that time period. Each post is marked with the sentence “Tag a friend who lacks…” and represents an individual draw, all of which are part of the overarching sweepstake.

  • Post #1: The first promotion of the Sweepstake begins on October 01, 2024 at 10:00 am CEST and ends on October 02, 2024 at 03:00 pm CEST (“Entry Period”). To be eligible for the sweepstake, entries must be received within the specified Entry Period. 
  • Post #2: The second promotion of the Sweepstake begins on October 08, 2024 at 10:00 am CEST and ends on October 09, 2024 at 03:00 pm CEST (“Entry Period”). To be eligible for the sweepstake, entries must be received within the specified Entry Period. 
  • Post #3: The third promotion of the Sweepstake begins on October 15, 2024 at 10:00 am CEST and ends on October 16, 2024 at 03:00 pm CEST (“Entry Period”). To be eligible for the sweepstake, entries must be received within the specified Entry Period.
  • Post #4: The third promotion of the Sweepstake begins on October 22, 2024 at 10:00 am CEST and ends on October 23, 2024 at 03:00 pm CEST (“Entry Period”). To be eligible for the sweepstake, entries must be received within the specified Entry Period.
  • Post #5: The third promotion of the Sweepstake begins on October 29, 2024 at 10:00 am CET and ends on October 30, 2024 at 03:00 pm CET (“Entry Period”). To be eligible for the sweepstake, entries must be received within the specified Entry Period.

5. participation
  • Eligible entrants can enter the sweepstake by tagging a friend in the comments on any of the Sweepstakes entry posts, liking the posts, and following the @trickstuff_official Instagram account. Comments and likes on a specific entry post enter the entrant in the running for the prize of that specific post
  • Eligible entrants can comment on all sweepstake posts. Multiple comments by a single entrant on a single post will not be considered.
  • Participation in the sweepstake is free of charge.
  • As a participant, your entry must fully meet all sweepstake requirements, as specified in the Official Rules, in order to be eligible to win a prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor's sole discretion. 
  • Fraudulent methods of entry or circumvention of the rules may result in the Sponsor invalidating your entry/entries and removing it/them from the sweepstake at the Sponsor's sole discretio
  • Comments that violate Instagram rules, German law or copyright will be removed without prior notice. In such cases, the person who posted the comment will be automatically excluded from the sweepstake.
6. prizes

  • The Winner selected from the Entry Post #1 (the “Winner1”) will receive a set (front & rear) of Trickstuff Brake Pads STANDARD for both, the winner and the tagged friend. 

  • The Winner selected from the Entry Post #2 (the “Winner2”) will receive a Trickstuff Dächle Disc HD for both, the winner and the tagged friend. 

  • The Winner selected from the Entry Post #3 (the “Winner3”) will receive set (front & rear) of Trickstuff Brake Pads POWER for both, the winner and the tagged friend. 

  • The Winner selected from the Entry Post #4 (the “Winner4”) will receive set (front & rear) of Trickstuff Brake Pads POWER+ for both, the winner and the tagged friend. 

  • The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the Sponsor. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is non-transferable. The Winners, upon acceptance of the prize, are solely responsible for all expenses, taxes, etc. related to the prize, including without limitation any and all local, state, and federal taxes. The Winners shall not transfer assignment of the prize to others, nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law. 
7. ODDS

The total number of eligible entries received determines the odds of winning. Multiple entries by a single entrant will not be considered. 

 

8. Selection and notification of Winner
  • The Winners will be selected by a random drawing using an external platform under the supervision of the Sponsor.
  • The Sponsor will notify the Winners through direct message on Instagram within 48h following Winners selection, asking them to send an email to marketing@trickstuff.com to confirm their identity and eligibility.
  • In addition, the Winner will be asked to submit their current brake model as Trickstuff Brake Pads and Discs are available for most common disc brake systems. Winners must provide their brake model details to receive a suitable product.
  • The Sponsor is not responsible for, nor shall have liability for, Winners failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall the Sponsor be liable for Winners provision of incorrect or otherwise non-functioning contact information. If a Winner: 1) fails to claim the prize within 72h from the time the award notification was sent; or 2) is found ineligible for any reason determined by the Sponsor, the prize may be forfeited and an alternate Winner may be selected. Receipt of the prize (offered in the sweepstake) by the Winners is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF WINNERS VIOLATES ANY OF THESE OFFICIAL RULES, WINNERS (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNERS WILL BE IMMEDIATELY TERMINATED.
9. Rights Granted by You 

By submitting an entry (e.g., text, video, photo, etc.) into this sweepstake, You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, likeness, image, statements about the sweepstake, and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration. 

 

10. Terms & conditions

In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the sweepstake should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the sweepstake. The Sponsor, in the event of any of the above issues, may determine the Winners based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the sweepstake or website or violate these Terms & Conditions will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the sweepstake, to void votes for any reason, including, but not limited to:  multiple entries, must be original work and not violate anyone’s proprietary or intellectual property and copyright rights. Entries that infringe upon the intellectual property rights of others will lead to disqualification of the participant. You shall defend or settle against such claims at your sole expense, and You shall indemnify, defend and hold harmless the Sponsor from any suit, etc. that You cause by failing to comply with any term or condition of these Rules.   

 

11. Limitation of Liability 

Your entry into this sweepstake constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the sweepstake and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries. 

 

12. Applicable law

The Sponsor's competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

14. WINNERS LIST

  • The Winner of Entry Post #1 of the sweepstake (the “Winner1”) will receive a set (front & rear) of Trickstuff Brake Pads STANDARD for both, the winner and the tagged friend. 

  • The Winner of Entry Post #2 of the sweepstake (the “Winner2”) will receive a Trickstuff Dächle Disc HD for both, the winner and the tagged friend. 

  • The Winner of Entry Post #3 of the sweepstake (the “Winner3”) will receive set (front & rear) of Trickstuff Brake Pads POWER for both, the winner and the tagged friend. 

  • The Winner of Entry Post #4 of the sweepstake (the “Winner4”) will receive set (front & rear) of Trickstuff Brake Pads POWER+ for both, the winner and the tagged friend. 

  • The Winner of Entry Post #5 of the sweepstake (the “Winner5”) will receive a Trickstuff Dächle Disc UL for both, the winner and the tagged friend.

You may obtain a copy of the Winners' names or a copy of these Official Rules, by sending your request via mail with a stamped, self-addressed envelope to: Trickstuff GmbH, Schwabenmatten 17a, 79292, Pfaffenweiler, Germany. Requests must be postmarked no later than 7 days after the winner's announcement. 

 

15. Declaration of exemption

The sweepstake hosted by Trickstuff GmbH is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram or other social media channels. 

 

16. Conditions of profit and participation 

Should individual provisions of these Terms and Conditions of Participation be invalid or incomplete or should fulfillment become impossible, this shall not affect the validity of the remaining parts of the Terms and Conditions of Participation. In this case, the ineffective provision shall be replaced without further ado by a permissible effective provision which comes closest to the original intention in terms of its content.
